Status of professional trainees
In this back-to-school season, a brief reminder seems necessary about the special status of company interns.
The professional internship allows you to enter working life while putting your theoreticaléoric knowledge into practice in the field....
BUT BEWARE : an intern is not an employeeé....
Internship agreement :
An agreement is essential. However, it must êbe related to the school curriculum.

In all cases, in the event of extension, an amendment à to the agreement is required or épossibly a new agreement will êbe signedée.
Place of the trainee :
The trainee must never replace an employeeé.
Dèaprèsès les textes : aucun stage ne peut êêtre conclu pour un remplacement provisoire de salarié, pour un emploi saisonnier, pour un surcroît d’activitéé ou pour occuper un emploi permanent.
Ruliégulièrement, les tribunaux sont saisis de demandes de requalification de contrats de stage en contrat de travail....
In theory, the différence seems simple under a contract of employment, the employeeés relationship of subordination to the employer exists. And as the Cour de cassation has stated: « the relationship of subordination is characterizedérisé by the exécution of work under the authorityé of an employer who has the power to give orders and directives, to control the exécution thereof and to sanction the failings of his subordinateé ».
Théorically this link is non-existent within the framework of the internship contract.
In any case, in the event of requalification of the internship as an employment contract, the company would be condemned to à back pay on the minimum basis of the Smic, à compensation for paid leaveés and à compensation for unfair termination.
Trainee's rights :
Any absence must êbe authorizedéby the company. The trainee is not entitled to paid leave.
The trainee remains affiliatedé à his Sécurité Sociale scheme.
He bénéficie de la législation sur les accidents du travail et les maladies professionnelles.
Internship periods are not taken into account when calculating retirement...
If you are hired à at the end of the internship, the duration of the internship is taken into account in the duration of the trial period. However, it cannot êbe reduced by more than halfé....
Important information : a bonus of 3000 € is grantedéto companies that hire their interns on permanent contracts....
Rémunération :
If the internship lasts more than 2 months, it’s an obligation for the company. The minimum wage is set at 30% of the SMIC, i.e. 417.09 net per month for a 35-hour week.
For an internship of less than à 2 months, the company is not obligedéto pay a rémunération but may pay a bonus.
If the internship is longer than érieur à 3 months, the income (net tax amount) must êbe déclarés.
For info : for those over 25, on January 1er of the tax year, the young person can no longer êbe attachedé to his parents' tax household...
