Professionalization contracts: new hiring incentives
Newés on apprenticeship and professionalization contracts for SMEs...
As of March 1, following à the announcement by the President of the Républic, the à aid ’hiring allocatedéto employers of SMEs (Small and Medium-sized Enterprises) for any additional hiring oféa young person on an apprenticeship or professionalization contract has been introduced.... (décret N° 2011-523 du 16 mai 2011, JO du 17-05-2011)
Conditions d’attribution :
L’aide est accordée à tous les employeurs ayant moins de 250 salariésés qui embauchent un jeune de less de 26 ans en contrat d’apprentissage ou en contrat de professionnalisation.
However, the contract start date must be between March 1 and December 31, 2011. In addition, the hiring of the young person must result in an increase in the number of employees on work-study schemes compared to à the number recordedé on February 28, 2011.
Attention, l’aide ne peut être accordée :
- For contracts giving entitlement to à a total exemptionération of employers' social security contributions,
- If the employer has proceededédé, within 6 months prior to theécè
- If the young person has been a member à of the company's workforce during the 6 months prior to recruitment.
Calculation of the amount of aid :
The amount of aid differs according to the status of the young person, à namely apprenticeship or professionalization contract.
- Case of hiring under an apprenticeship contract (in mainland France):
[SMIC per hour applicable on January 1 of the current year] x 151.67 x [% of SMIC perçu by the apprentice à on the date of the end of the contract (note : the percentage varies according to the apprentice’âs age and his/her progress in the training cycle) - 11%] x 0, 14 x 12
- Case of hiring under a professionalization contract (the amount varies according to the company’s workforce) :
For companies with less than 20 employeesés: [SMIC per hour applicable on January 1 of the current year] x 151.67 x [% of the SMIC perçu by the apprentice à on the start date of the contract (please note : the percentage varies according to the apprentice’âs age and his/her progress through the training cycle)] x 0.12 x 12
For companies with more than 20 employeesés, the amount of aid is égal à : [SMIC horaire applicable au 1er janvier de léannée en cours] x 151,67 x [% du SMIC perçu par l’apprenti à la date de début d’exécution du contrat (attention : the percentage varies according to the apprentice’âs age and progress through the training cycle)] x 0.14 x 12
The amounts obtained are rounded up à to the next euroérieur.
How to bénébenefit from the aid?
Two months after the end of the contract, the employer must send à Pôle Emploi :
- A form stating the average annual headcount of employeeséemployedéon work-study contracts as at February 28, 2011, and that of employeesés employés en alternance au terme du mois au cours duquel l’embauche éligible a été réalisée
- Une copie du contrat d’apprenticeship contract or professionalization contract, and a copy of the registration decision for apprenticeship contracts, or of the decision to be financially supported by the organisme paritaire collecteur agréé in the case of professionalization contracts.
If the application is acceptedéthe aid is paidéà to the employer in 2 stages:
- The first 6 months are versés 3 months after the dégoal of the exécution of the contract or, for hires prior to à the publication of the decree, between May 17 and August 17, 2011
- The last 6 months are attributedés during the 10th month of the contractés execution.
To trigger this second instalment, the employer must send a certificate 2 months before à Pôle Emploi confirming that the contract for which the aid is requested is still running on the 10th month.
If the contract is terminated, the aid is repaid by the employer to Trésor Public :
- In its entiretyégralité if the breach occurs during the first 6 months of the contractés execution,
- In proportion to the number of months the young person has been present if the breach occurs between the 7thèand 12thèmonths of employment.
