New provisions for declarations of employment

As of 1er août prochain, (suite au décret N° 2011-681 du 16 juin, J.O. du 18-06-11), la déclaration préalable à l’embauche et la déclaration unique d’embauche fusionne en une seule déclaration.

The latter will have êto be carried outéby the employer à on the occasion of the hiring of’an employeeé through the « déclaration préalable à l'embauche » rénovée.

A number of mandatory éléments must be included in this single document, à namely :

  • The corporate name of the company or employer, the APE code, the employer's contact details, the number of the identification system for the register of companies and their establishments, and the contact details of the occupational health department responsible for the employer
  • .
  • The employee's name, surname, sex, date and place of birth, social security number
  • .
  • The date and time of hiring,
  • The nature, durationée of the contract and période d’essai.

 

In parallel, this document will enable à the employer to register with the régime de la sécurité sociale, d’register the employeeé à with the CPAM, join the unemployment insurance scheme and request the medical examination for employment.

This déclaration préalable à l’embauche must êêtre adressée at the earliestôt within eight days of the prévisible date d’embauche à l’organisme  for the collection of social security contributions to which the employer relates either by e-mail, fax (avis de réception à retain)or by posté registered mailé with acknowledgementé of receipt.

Within five working days of receipt of the declaration required à for hiring, the recipient organization sends à the employer an acknowledgement of receipt of its declaration, a copy of which êmust be given to the employee éat the time of hiring.
